HCR-23 Task Force meeting. Two CSG Justice staff members attended in person and one CSG Justice Staff member attended via Zoom. There were 26 participants present. Fred Hyun (Chairman, HPA), accompanied by HPA member Gene DeMello and former HPA member Judge Michael Town (ret.), conducted three mock HPA minimum hearings based on real cases, with case information redacted. The cases represented Class C, Class B, and Class A offenses, with a public defender providing the defense role in two cases (Class C and Class A), and other individuals playing the role of the person incarcerated in each case. The mock cases illustrated how HPA interacts with incarcerated people. The Class A case prompted a lengthy discussion, with the public defender addressing each factor in the HPA guidelines grid. This highlighted the courteous interactions within the HPA and the consideration of various factors. Due to prior probation and pretrial time, the incarcerated person had significant jail time credit, leading to a minimum sentence of 2.1 years. In the Class B case, the person proceeded without an attorney, leading to a continuance. In a more complex Class A case, the incarcerated person, with convictions for lower-level offenses and an appeal for a Class A offense, declined to answer questions. After deliberation, a continuance was requested by the defense. Dr. Erin Harbinson (Director, Criminal Justice Research Institute, State of Hawaii Judiciary) addressed data analysis process and potential research questions. Â
