CHJ COSSAP Grantee Quarterly Call was scheduled for September 14, 2023 from 2:00pm - 3:30pm ET. These calls are an opportunity for grantees to check-in with us at CHJ, meet other grantees, and learn about topics related to deflection and pre-arrest diversion initiatives. Invited are CHJ's FY19-22 deflection and pre-arrest diversion grantees. After a brief introduction to the CHJ team and our TTA support, we were joined by two presenters.
In collaboration with representatives from the Legislative Analysis and Public Policy Association (LAPPA), this COSSUP grantee cohort focused on “The Legal Liabilities of Deflection." This call featured an explanation and in-depth discussion of the legal concerns frequently encountered by programs engaging in deflection and pre-arrest diversion. The presenter will identified common challenges and explore strategies to minimize legal liability while successfully navigating issues associated with confidentiality requirements, naloxone administration, and other topics.
Summary of call: LAPPA's presentation outlined 4 major types of risks that Deflection and pre-arrest diversion initiatives face during their operation - legal liabilities associated with programmatic activities and data collection methods, negative political or public perceptions of programmatic activities and goals, unequal or biased application of initiative resources and activities, and an inability to sustain or adapt over an extended period of time. The presentation then went on to provide an in-depth overview of the critical federal and state laws and regulations that impact data collection and information sharing procedures in deflection and diversion initiatives, such as HIPAA, 42 CFR Part 2, and 28 CFR Part 23. The presentation also provided guidance on how to remain in compliance with these regulations while ensuring the project is effective and efficient.
